Job Type: Full Time Position Summary:
This position will administer the corporate Legal Information Request and Subpoena Procedure, which includes direct administration and coordination of responses to first and third parties to requests for information maintained by the company, including, but not limited to, patient records, prescriber information, employment records, financial information, process and operations information, and regulatory records. The Legal Analyst will develop and distribute internal training (including written work instruction for all training) for the proper deployment of new and existing response Policies & Procedures. Research outstanding requests or calls that are escalated internally as well as from customers, regulatory agencies, etc. to provide an acceptable resolution to the situation in an efficient and timely manner.
•Intake administration to individually track requests coming to company and provide de-confliction of any duplicate requests
•Prepare initial response to include rejection or modification of request; request additional information or authority from requestor, or note in processing status to requestor.
•As required, route request to appropriate attorney in the Legal Department for review and action response and work with attorney to respond to requestor.
•As required, route request to appropriate compliance team for notification and action.
•If requestor is demanding testimony in connection to appropriate business records, attempt to allow for an affidavit in lieu and, if not possible, direct to appropriate member of legal team to arrange for company records custodian and representation for the custodian.
•Upon appropriate approval (including from Legal, Compliance, or policy-based), determine what information is responsive and appropriate process to invoke.
•Work with information custodians to address the retrieval of information requested.
•Perform quality assurance to address the accuracy, integrity, and appropriateness of the information to go into the response to the request.
•As required, route completed (or in cases permitted by procedure, partial) information responses to Legal and Compliance for approval and/or notification.
Responsible for ensuring responses incorporating Protected Health Information and Personally Identifiable Information satisfy regulatory demands and subpoena requests in accordance with state and federal HIPAA/Privacy requirements. Assist and Lead with department projects. Perform such other duties as assigned. Required Qualifications:
2-5 years of relevant experience in a corporate environment. Preferred Qualifications:
5-8 years of related work experience using related skills. Paralegal Certificate preferred. Previous experience in a legal, compliance, or privacy environment. Education:
Associate/Bachelor's Degree Preferred. Business Overview:
