Description

Employment Lawyer (PQE5+) to sit in the Hong Kong legal team and dedicated to advising the Bank on all aspects of the employment relationship. The Employment Lawyer will work collaboratively with Human Resources, Employee Relations, Legal Compliance and business colleagues to manage employment law matters, including practical, commercial and solution driven advice on a wide range of issues. This position will be based in Hong Kong working closely with the Asia Pacific Legal Compliance, Human Resources and Employee Relations teams and interacting with colleagues globally.

Principal Duties and Responsibilities:

  • All aspects of employment law, including drafting contracts, letters, policies; reviewing outsourcing and data privacy issues; employment aspects of transaction; regional benefit reviews.
  • Keeping track of regional legal developments and preparing know how summaries
  • Advising Human Resources and Employee Relations on legal aspects of resolution: performance management, disciplinary actions, terminations and grievances - including cross border, expatriate and regional matters
  • Assist with the investigation of potential violations of law, regulation and Bank policies
  • Advise on impact of policy breaches including e-mail and internet misuse and confidential information misuse
  • Project work may include for example the employment law aspects of benefit policy reviews, introduction of technology enhancements to recruitment and employment processes, automation of compliance systems
  • Legal advice in respect of involuntary terminations and legal implications of implementation of severance policies
  • Assist in formulating, interpreting and communicating policies that pertain to employee issues
  • Management of employment litigation
  • Presenting training for Human Resources
  • Management of external legal counsel
